Cosa prevede la nuova procedura
A partire dal 3 luglio 2010 (tre mesi dopo l’entrata in vigore del DM 26/02/2010), è diventata operativa a tutti gli effetti la certificazione elettronica della malattia da parte dei medici curanti e delle strutture del Servizio Sanitario Nazionale. Anche IBM Italia si è adeguata a questa procedura telematica.
Di conseguenza:
L’Inps ha istituito un numero verde gratuito 803164 che fornisce assistenza ai datori di lavoro e ai lavoratori tramite gli operatori
del Contact Center Integrato Inps-Inail.
Gli operatori del Contact Center forniscono telefonicamente supporto nella navigazione e uso delle procedure di consultazione dei certificati,
inviati telematicamente dal medico curante, nonché le informazioni e le risposte ai quesiti di interesse generale sulla materia.
Il Contact Center assiste, inoltre, i lavoratori anche per l’assegnazione o attivazione del PIN cittadino, necessario per la consultazione e
stampa dei propri certificati di malattia.
Cosa deve fare il lavoratore
Nel corso della visita medica il lavoratore deve:
Il lavoratore avente diritto all’indennità di malattia a carico dell’Inps, in base alle nuove disposizioni, non è più tenuto a trasmettere all’Istituto il certificato di malattia, eccetto i casi di impossibilità di invio telematico; a questo proposito va osservato che in IBM, come in altre grandi aziende, anche prima del certificato di malattia elettronico non sussiteva l'obbligo, per il lavoratore interessato, di invio all'INPS del certificato medesimo.

I periodi indicati nella Tabella 1 possono prolungarsi come specificato nella Tabella 2, dando origine al periodo convenzionalmente definito comporto lungo, se nel triennio intervengono i seguenti casi:

Esaurito il periodo di consevazione del posto, il lavoratore può richiedere un’aspettativa non retribuita per un massimo di 4 mesi, rinnovabile fino ad un massimo di 18 mesi continuativi e complessivi, previa richiesta scritta e periodica, certificando all’azienda la condizione di malattia grave.
Il periodo di aspettativa che il lavoratore può richiedere è aumentato di 6 mesi (da 18 a 24), qualora, a causa di malattia prolungata, il medesimo non sia in grado di riprendere il lavoro una volta scaduto il periodo di conservazione del posto previsto contrattualmente.
L’elenco delle malattie che non danno luogo al raddoppio, in caso di eventi brevi ma ricorrenti, è stato aumentato inserendo le seguenti patologie: gravi malattie cardiocircolatorie, epatite B e C.
Anche il Day Hospital è riconosciuto come ricovero e, pertanto, in questo caso non si può dar luogo al raddoppio.
Dal 1° Gennaio 2000, per due volte l’anno e su richiesta del lavoratore, le imprese devono fornire la situazione del cumolo malattie per il conteggio del comporto.
La malattia interrompe le ferie solo in due casi:

Illness
This matter is ruled both by the law and the Metalworkers' Industry-wide Agreement. The regulations here below summarized apply in general to the workers of the metalworking industries, and therefore also to IBM Italy employees, where, if the illness does not last more than 2 days, the term "indisposition" is conventionally used; but to this end the only difference between illness and indisposition is that in case of indisposition no doctor's certificate must be provided.
The worker's obligations
The ill worker must very carefully comply with the following instructions:
1. Inform the company within the first day of absence;
2. If the prognosis (illness duration) is more than 2 days, send to the company, within the second day and by recorded delivery with acknowledgment of receipt, the doctor's certificate. As in IBM and in many other big companies there is no obligation to send to INPS (Italian National Institute of Social Insurance) a copy of the certificate, the doctor can draw up the certificate on headed paper, without being required to use the red forms provided by INPS; if the doctor uses these forms, the worker must only deliver to the employer the form with the prognosis, while the form with the diagnosis must be kept by the worker him/herself, as it is a classified piece of information not concerning the employer);
3. If the illness lasts further, inform the company within the first day after the expiration date of the first illness period, and send to the company, within the second day and by recorded delivery with acknowledgment of receipt, the doctor's certificate.
Besides, the worker must communicate immediately to the company and to the INPS department with territorial responsibility if, during the period of absence due to the illness, he/she will stay at a different address from his/her own, also because of the possible controls the company may require that the Institute for Social Insurance performs during the appropriate time slots, or the Institute may decide itself to perform,.
If the company was not informed or the doctor's certificate was not sent, unless there are justified hindrances, the worker is deemed absent without leave. The days of illness before a doctor's certificate is provided are excluded from the calculation of the compensation.
Nota Bene
In IBM (like in many other big companies) there is a normal praxis, and therefore a vested right for all employees, concerning a specific type of illness, called "indisposition". This means that in case of absence because of illness with a duration less than 3 days (2 days illness and return to work the third day), it being understood that the employee must inform the company within the first day, he/she is exempted from the obligation to deliver a doctors' certificate; however, the doctors' certificate is required if the "indisposition" occurs on Saturdays or on Mondays. By the way, all obligations described in the below paragraphs as far as the controls, the time slots and the obligation to stay at home are concerned, are valid also in case of "indisposition".
Electronic Certificate of Illness
The new procedure. Since 3 July 2010 (three months after the Minister decree DM 26/02/2010 came in force), the electronic certification of illness has come into effect to be applied by medical doctors and the National Health Service (SSN).
Controls and time slots
Law 638, 1983 (art. 6) provides the rules concerning the control
of the illness.
Based upon this law, a decree of the Minister fixed the time slots when a worker must be present at home. T
hese slots are valid all days of the week, including Saturdays and Sundays, and unless there are justified
reasons for being absent the worker must comply with them.
The timetable is the following: from 10 AM to 12 AM and from 5 PM to 7 PM. The industry-wide agreement establishes
that the worker who has to leave his/her home for justified reasons must anyway provide the company with this
piece of information.
Important: if the worker was not present at his home during the time slots, he/she must report anyway
to the ASL (Local Health Authority) out-patient department for a controlling medical examination at the time
specified on the card left by the doctor in his/her letter box.
Obligation to be at home
Changing address, without communicating it, and therefore not being at home
for the controlling medical examination is not a justified reason of absence, and results in salary and disciplinary
measures.
The absence during the time slots without justified reasons causes for the employee the following salary measures:
· First controlling medical examination: being an absentee causes the loss of salary for the first 10 days of illness;
· Second controlling medical examination: being an absentee causes the loss of 50% of salary for the remaining period;
· Third controlling medical examination: being an absentee from home for the third time during the same illness causes the total loss of salary from that moment to the end of the illness.
Besides, the industry-wide agreement establishes that the worker may also be subject to disciplinary measures.
Cancer pathologies
In case of cancer, Law 80, 2006 (art. 6 clause 3bis) provides that a Medical Committee of the ASL verifies within 15 days the worker's civil disability, and as the results of the verification have immediate effectiveness the worker is entitled to make use of leave of absence according to art. 33, Law 104, 1992.
